(AP) -- CORUNNA, Mich. - NBC25 has confirmed Harlan Drake has been found competent to stand trial. However, prosecutors and defense attornies are still arguing over additional competence testing. Harlan Drake is accused of killing an abortion protester and another man in Owosso.
Defense attorney Robert Ashley says experts have found that Drake is competent to stand trial and understands the charges and can assist his lawyers. Drake was found incompetent less than a month ago, but he's been getting treatment.
He's charged with fatally shooting James Pouillon while the victim protested abortion outside Owosso High School on Sept. 11. Drake is also charged with killing businessman Mike Fuoss.
Although Drake has been found competent at this time, his lawyer still could raise an insanity defense.
