NBC25 has learned the Michigan Department of Human Services is asking a court to throw out a case brought against it by Midland's Mackinac Center Legal Foundation.

The Mackinac Center says DHS is forcing child-care providers to join a union and pay union dues.

DHS says the case should be thrown out due to a technicality.

The Mackinac Center says, nearly $4-million in union dues are being taken out of Michigan subsidy checks illegally.

DHS says it can't comment on pending litigation.
