OWOSSO, MI -- ***UPDATE AS OF 6:16PPM EDT:

According to Shiawassee County Prosecutor Randy Colbry, "The indication is that he had ill will ... a grudge against these three individuals."  Harlan Drake was also licensed to carry a concealed weapon.  Authorities are seeking a .22 caliber gun and a .45 caliber gun they believed were used in the shootings. 

Fuoss’ brother-in-law, Glen Merkel, told the Detroit Free Press that Fuoss was found shot dead in his office around 7:30 a.m. by an employee. He said Fuoss was seen alive perhaps 20 minutes earlier when another truck driver for his company came to pick up a load of gravel.

***UPDATE AS OF 5:46PM EDT:

Harlan Drake has no previous criminal record.  The nature of the crime, hatred towards a pro-life activist and his material, prosecutors have contacted federal authorities and this could be procecuted as a hate crime.

***UPDATE AS OF 5:12PM EDT:

Detectives with the Owosso Police Department have told NBC25 that Harland Drake had not made an attempt on James Howe's life.  After he killed the first 2 gentlemen, he went home before he was going to try and find Mr. Howe.  Police were waiting at his house when he came home after killing Jim Pouillon and then Mike Fouss.  The suspect, Harlan Drake is presently married.

***UPDATE AS OF 4:47PM EDT:

The shooting suspect, Harlan James Drake, was arraigned and given no bond.  An arraignment date has been scheduled for 9/25/09 at 2:30pm in the 66th District Court.

***UPDATE AS OF 3:39PM EDT:

Harlan Drake or "Hale" as he is known to friends is now charged with 2 counts of 1st Degree Premeditated Murder for the killings of James “Jim” Pouillon and Mike Fouss.  Police say that Harlan Drake has told detectives that he had a list of 3 people in his head that he wanted to kill. 

Two of the people on his "list" have died as a result but the third, James Howe, was not attacked.  Since he has admitted to a third person on his hit list, it is resulting in a charge of unlawful intent with a firearm.  There is no motive behind Mr. Howe or Mr. Fuoss, who owned the Fouss Gravel Company.  There is only one known connection between Mike Fouss and Harlan Drake, his mother used to work for Mr. Fouss.

As to the reason for the killing of pro-life activist Jim Pouillon, Harlan Drake has told police that he was “offended” by Pouillon’s anti-abortion messages.  Neighbors of Jim Pouillon say that he was a quiet man in recent years but his checkered past was a result of his boisterous protests.  They have commented that some might not have agreed with his message or his graphic displays of aborted fetus’ on his protest signs but he was quiet man in his older age.  

Charges:

2 counts of 1st Degree Pre-meditated Murder

1 count of Felony Firearm Possession

1 count of Unlawful Intent with a Firearm

***UPDATE AS OF 2:04PM EDT:

Police have released the names of the victims in a double shooting in Owosso.

At approximately 7:20 a.m., Jim Pouillon, a prolife activist, was shot and killed at Owosso High School.  The shooter then drove to Fuoss Gravel where, around 8:17 a.m., President Mike Fuoss was also shot and killed.

Police believe Fuoss and Pouillon knew each other, and probably were acquainted with the shooter.

The entire Owosso school district was put on lock down early this morning. The Elementary, Middle, and Alternative Ed school have since been taken off the lockdown. The high school is releasing students if parents come and sign students out, otherwise students will remain in the building throughout the remainder of the day.

NBC25 is told Pouillon was well-known for his pro-life activities in the city of Owosso.  He often stood in very visible areas with large graphic anti-abortion signs.  The interim superintendent, Susan Wooden, says he was also well known at the High School where he would stand most mornings while students walked into school. The Flint Area Right to Life says Pouillon was a quiet man who prayed often in front of schools and local organizations.

Approximately 45 minutes after the shooting, police apprehended a suspect.  At this time, NBC25 does know the name of the suspected shooter and will hold the release of his name.  Police are not releasing the suspects name until warrants have been issued.  The Shiawassee County Sheriff's Department says the suspect himself and witnesses are being interviewed.

*All after school activities in Owosso School District have been canceled out of reverence for the victims and their families.

* The Shiawassee County Prosecutor, Randy Colbry, has announced he will be holding a 3:00 p.m. press conference. NBC25 has team coverage on this story and will update you when we learn more.

Owosso Murders

Everyone seems to be offended due to the lack of publicity Mike Fuouss has gotten. Nothing has really been said about him or his family. The part that bothers me is that everyone is stating that "since he was a well known business man in Owosso he should be recognized". In my opinion the fact that he was a well known business man should have nothing to do with it, how about that he is a MAN or better yet a Person whose life is worth just as much as someone’s name we don't recognize.

There’s so much hype about the killing of James Pouillon; but what about Mike Fuoss. This shooter is a killer, with more than the abortion signs as motives; yet the news is filled with the abortion issue. Some reports say he had at least one more victim in his plan. Why aren’t any other motives being discussed?

Would it be as upsetting to many of you if it had been a pro-life advocate shooting a pro-choice advocate? I hate the way the media does everything it can to keep this country divided. Let’s concentrate on the murders instead of the abortion issue.

No, I don’t like abortion either; but this case isn’t about abortion, it’s about two murders.

Well hmmmm?? Your right there,no one has said anyting about Mike Fouss. From what I've found out from people who did know him is that he has stepped on ALLOT of toes and was a very ugly man(to politely put it)and many people did not like him for their own reasons. I guess you just step on the wrong toes sometimes. I've delt with all manner of people and you can't deal with them all the same. It's sad but you never know. Who knows what's on the mind of someone who kills at the time of the act. People have limits and deal with them different. It's sad but allot of things come into play,more than meets the normal eye. You'd never in a million years imagine where their mind is at that time. It's very sad for all involved and extended families,even Harland Drake's. The sign man,it was a matter of time and he knew he was offending allot of people yet continued. More with the pictures than the sign I beleive. He had the right but people also have the right not to have that stuff in front of their children. Nothing ever should be pushed on to other people whether it be religion,polotics,sex,or your own beleifs,they may not be that of others,hence freedom and rights of all.

Still this morning the only focus in the news in on Pouillon. What about Mike Fouss. He and his family have been in and active in Owosso and Shiawassee County for years. Why don't the news outlets spend some time on him?

This incident has to have the Least amount of Logic attached to it I have seen in a very long time.

Did he kill these people because their exercise of "free speech" against abortions was upsetting to him?
If so, what exactly was he hoping to accomplish with this?

I am not against or for abortions. I am not a woman, and it si not my responsibility to tell other people what to do with their medical concerns...
That being said- If I were pro-Choice, and if I wanted to prove a point or possibly reduce the voices from the other side of the argument- I would try to find a common belief, and at least try to 'agree to disagree.'

What was he trying to prove? He certainly did not prove that Pro-Choice people are somehow more pious or courteous.

If someone was against your perspectives- such as pro-lifers against pro-choice... Wouldn't you try to prove that you are not a bloodthirsty barbarian? Apparently that is not the logic he was looking for.

Very unfortunate. Violence is good for very little beyond defense. All other motives are offensive.

This murder, as are all others, was just that. Offensive.

Since when did holding up a sign about your beliefs become motive for murder? Why does anyone think this man deserved to be shot? I lived in Owosso for 3 years, and yes I saw the signs, but as stated in a previous comment, everyone has the right to look away. I personally did not find his signs to be offensive. He was a quiet man who was trying to relay a message peacefully.

You know whats sad???...all this stuff about "I feel bad for the anti-abortion guy" and "I don't feel bad cuz he was wrong"....What about Mike Fuoss?!? how come everybodys so concerned about one but not the other? Fuoss has been a long and strong going company in owosso for years...and nobody wants to recognize him...just the anti-abortion guy.

Well we have Theives,Drugs,and Murders in Owosso. We had a drug bust recently and the police were on top of it. Job well done... When are the people going to band together and help each other?? Go back in time,get off your duff and get to know your neighbors and what's going on around you. Don't sit back and watch what's going on and do nothing!! HELP out.. Clean this mess up... Sometimes you have to help take back your good town where you can walk down the street at night or leave things unlocked etc....As far as the man with the sign,,Hmmmm??? That's offensive to people and children and they also have the RIGHT not to see such a thing and you don't need it shouved in your face to know what's going on. People have the right to abortion in certain circumstances but shouldn't use it as a form of birth control but that's still their right...Way to many children are in the system and no where to go...Why have more?? Beleive it or not the public isn't stupid but KEEP YOUR OPINIONS TO YOURSELF unless you are asked.. Then your not hurting other people...You don't shove religion,politics,or anything else on other people. There will always be 2 sides to a coin and everyone doesn't agree. You have to agree to disagree.

I in no way agree or support abortion but I also have small children who do not need to see a mangled baby on a sign. I Do not believe he should have been shot either! But he could have done his signs with out those pictures and got his point acrossed! I think it will be interesting to find out what this "person" has to say about why he did what he did! I want to send my thoughts and preyers to the families involved!

When did we start supporting murder and quite supporting right to opinion? This man was not violent, he just sat there with signs,no matter what they said or what pictures they had on them you could walk away, you could turn your head. He's been standing up for his beliefs for years and I have never heard of any violence.
Why are we pointing out HIS WRONGS, because of his signs or where he stood instead of the wrong doings of the KILLER who shot him and someone else! So what was Mr. Fouss crime that he deserved to die?

his signs were extremely graphic... other posts say that he had a sign with a babies face advertising his "pro-life" beliefs. but he also had an anti abortion sign... which had an actual picture taken of a mangled, dismemberred, bloody corpse of an aborted fetus. and he would protest in public places such as schools, the flea market, and local fairs. especially the high school...
